LGBTQ+ rights policy covers legal protections from discrimination, recognition of same-sex relationships, healthcare access for transgender individuals, and civil liberties for lesbian, gay, bisexual, transgender, and queer Americans. The legal landscape has shifted dramatically over the past two decades. The Supreme Court's Obergefell v. Hodges decision (2015) established marriage equality nationwide, and the Respect for Marriage Act (2022) codified it federally โ€” protecting same-sex marriages even if the Supreme Court were to revisit Obergefell. In employment, the Supreme Court's Bostock v. Clayton County (2020) ruled that Title VII of the Civil Rights Act prohibits discrimination on the basis of sexual orientation and gender identity. However, a comprehensive federal non-discrimination law covering housing, public accommodations, and credit does not yet exist โ€” the Equality Act has passed the House but has not cleared the Senate. Transgender rights have become the most contested dimension of LGBTQ+ policy since roughly 2021: more than 20 states have enacted restrictions on gender-affirming care for minors, bans on transgender athletes in school sports, and restrictions on restroom access, while others have enacted explicit protections. Federal courts are divided on these restrictions. Internationally, same-sex relationships are legally recognized in more than 35 countries, while criminalized in more than 60, illustrating the wide global divergence on these issues.

Why it matters

LGBTQ+ Americans face elevated rates of poverty, homelessness, mental health crisis, and discrimination without adequate legal protection. Federal policy determines whether gay and transgender people can marry, adopt, access healthcare, keep their jobs, and live openly without legal penalty. The current patchwork of state laws creates dramatically different rights depending on geography.
